What is Probate?
Probate lawyers in Orange Park and the Jacksonville area are often asked the question, “What exactly is probate?” I’ve found that many people hear the term for the first time and think it has something to do with being arrested for a crime. However, most people get familiar with what probate really is after losing a loved one or a friend or co-worker loses a family member.
Probate is simply the process that property belonging to a person that has passed away is distributed to their family members or whoever is supposed to get the property. The process is also designed to help creditors get money that they are owed from the decedent’s estate. The decedent is the person that passed away, while the decedent’s estate is the property that he or she owned.
